보고서는 이와 함께 우리 정부가 독도 영유권 주장의 근거로 삼고 있는 ‘맥아더 라인’에 대해서도 인정하지 않았다고 기록했다.
보고서에 따르면 한국 정부가 1952년 미일 평화협정(샌프란시스코 강화조약)에 맥아더 라인을 포함시켜 독도 부근에서의 일본 어선 조업을 영구히 막으려 했지만 이러한 조치는 미국이 지지하는 국제법의 원칙에 어긋나 한국 정부의 요구를 거부했다는 것이다.
맥아더 라인은 한반도 주변 공해상의 적 침투를 차단하기 위해 설정된 것으로, 미일 협정이 체결되면서 폐지됐지만 이승만 대통령이 ‘평화 라인’으로 고쳐 조업선으로 유지했다. 미국은 한국 정부에 조업선의 유효성을 인정하지 않겠다는 입장을 통보했으며, 국제법 위반이라고 항의했다는 것이다.
